1 · Purpose

These terms govern the customer’s use of the Vigilatum service during the private beta phase and for as long as there is no specific signed contract replacing them.

2 · Private beta phase

Vigilatum operates in private beta with limited places. During this phase:

• We do not sign service level agreements (SLAs) with penalty commitments.
• Prices and plans may be adjusted with reasonable prior notice.
• Certain features may be incomplete, in testing or subject to change.
• We maintain an internal high-availability target, but we do not yet guarantee it contractually.

3 · Acceptable use

The customer undertakes to use the service solely to monitor networks and devices that it owns or for which it holds express authorisation. The following are not permitted:

• Using Vigilatum to monitor third-party networks without their consent.
• Reverse engineering the probes or the agent beyond what is permitted by law.
• Attempting to access other customers’ data (multi-tenant).

4 · Customer data

The data generated by the probes (metrics, inventory, PCAP captures, recommendations) is the property of the customer. Vigilatum processes it solely in order to provide the service. The customer may request the export or complete deletion of its data at any time.

5 · Cancellation

The customer may cancel the service at any time, with effect from the end of the billed period. Vigilatum may terminate the service of a customer who breaches these terms, giving 15 days’ prior notice, save in the event of serious cause.

6 · Auto-remediation

The auto-remediation feature (DNS flush, service restarts, etc.) requires the customer’s explicit authorisation and an agent with elevated privileges. The customer acknowledges that these actions may have temporary effects on the remediated systems and expressly authorises their execution.

7 · Amendments

Vigilatum may amend these terms. Substantive changes will be notified by email at least 30 days in advance.

8 · Governing law

These terms are governed by Spanish law. For any dispute, the parties submit to the courts of the customer’s place of residence where the customer is a consumer or, failing that, to the courts of Barcelona.
